Terms of Use

1) Who We Are

Viridian Dads Club (“VDC”, “we”, “us”, “our”) is a volunteer community organization serving Viridian in Arlington, Texas. These Terms apply to our website (viridiandads.club), communications, and club-run events (collectively, the “Services”).

2) Accepting These Terms

By accessing the Services, purchasing tickets, registering for an event, or participating in club activities, you agree to these Terms and to any policies referenced here (including our Code of Conduct, Photo & Media Policy, and Privacy Policy).

3) Eligibility

• Adults (18+) may create accounts and purchase tickets.
• Parents/guardians are responsible for minors in their care at all times.
• Some activities have venue-set age/height/weight limits; please review event details before purchase.

4) Accounts & Security

• You agree to provide accurate information and to keep credentials secure.
• You’re responsible for activity under your account and for promptly reporting suspected misuse.

5) Tickets, Purchases, & “No Refunds Unless Canceled”

All sales are final. Except as stated below, we do not offer refunds for tickets, add-ons, or merchandise.

• Club-canceled event: If VDC cancels an event in its entirety, we will issue a refund or credit at our discretion. Third-party processing fees may be non-refundable if the processor does not return them.
• Rescheduled or relocated: If an event is rescheduled or moved to a reasonably comparable time/venue, tickets remain valid and no refund is provided. If you cannot attend the new date, you may transfer your ticket (see below).
• Weather: Many events are rain-or-shine. We may adjust timing, activities, or venue to proceed safely; such adjustments are not cancellations.
• Transfers: You may transfer tickets within the community before the event starts. Please coordinate the handoff and notify us via Contact with the new attendee name(s).
• No-shows / late arrivals: Not eligible for refunds or credits.
• Processing & chargebacks: You agree not to file chargebacks inconsistent with these Terms. Unpaid balances and invalid chargebacks may be referred for collection.

6) Third-Party Services

We may use third-party platforms (e.g., payment or ticketing providers). Their terms and privacy practices apply in addition to ours.

7) Event Safety & Participation

• Follow posted signs, venue rules, and staff/volunteer instructions.
• Use equipment/activities as directed; comply with capacity, age, and height restrictions.
• Supervise minors in your care at all times.
• We may deny or remove participation to protect safety or enforce our Code of Conduct. Removal does not entitle you to a refund.

8) Photo & Media

We may capture photos/video at events to promote community activities. By attending, you consent to reasonable recording and use as described in the Photo & Media Policy. To request an opt-out or removal, contact us.

9) User Submissions & License

If you submit content (e.g., testimonials, comments, photos you provide), you grant VDC a non-exclusive, royalty-free license to use, reproduce, and display such content for club purposes, subject to our Privacy Policy.

10) Intellectual Property

All site content, trademarks, logos, and designs are owned by or licensed to VDC. You may not copy, modify, or redistribute without permission.

11) Prohibited Conduct

• Harassment, bullying, or disorderly conduct (see Code of Conduct).
• Unauthorized commercial activity, ticket scalping, or misrepresentation.
• Interfering with site security, scraping, or attempting to access non-public areas.

12) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

13) Assumption of Risk; Release

You understand that recreational activities carry inherent risks. To the extent permitted by law, you assume those risks for yourself and minors in your care and release VDC, its volunteers, and partners from claims arising from ordinary negligence. (This does not waive liability for gross negligence or willful misconduct.)

14) Limitation of Liability

To the fullest extent permitted by law, VDC and its volunteers will not be liable for indirect, incidental, special, or consequential damages, or for amounts exceeding the price you paid for the applicable ticket(s) or $100, whichever is greater.

15) Indemnification

You agree to indemnify and hold harmless VDC and its volunteers from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.

16) Changes to Events & to These Terms

• Events: We may modify schedules, activities, or venues to address safety, weather, staffing, or other operational needs.
• Terms: We may update these Terms; the effective date will change above. Continued use after updates constitutes acceptance.

17) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree to exclusive jurisdiction and venue in the state courts located in Tarrant County, Texas.

18) Miscellaneous

• Severability: If any provision is unenforceable, the remainder remains in effect.
• Waiver: A failure to enforce a provision is not a waiver.
• Entire Agreement: These Terms and referenced policies are the entire agreement between you and VDC.
• Assignment: You may not assign rights without our consent.
• Notices: We may provide notices via the website, email, or at events.
